Amendment in Notice dated 27th November, 2007 under Section 80 of the Civil Procedure Code addressed to all of you.

 

After service of the aforesaid Notice, I received some more Information under RTI Act, which are required to be inserted in the notice. Therefore, I am sending following paragraphs to be inserted in the aforesaid (47 Pages) Notice dated 27th November, 2007, which also posted in Website at :- https://notice2unionofindianothers.tripod.com/

 

Under Paragraph 16 of the subject matter under heading FACTS RELATING TO DEVELOPMENT OF THE NEXUS BETWEEN SHRI JYOTI BASU and GROUP OF LAND MAFIA AND ITS AFFECTS, I have referred that how case was handled due to the nexus between Shri Kedarnath Fatehpuria and Shri Jyoti Basu. Now I also received Information under RTI Act, form the Home Department, form which it appears interalia that:-

The aforesaid matter of terrorizing by Kedarnath Fatehpuri to his respective tenants was registered as Bhawanipur Police Station (Kolkata Police) Case No. 479 dt. 2.10.94 u/S 148/149/427 IPC and 3 &5 E. S. Act against Kedarnath Fatehpuria and Mr. Pradip Banerjee and the matter is still subjudice. Mr. Kedarnath Fatehpuria was granted bail (in fat he was granted bail in the night and within 2/3 hours from his arrests, even case was registered for non-bailable offence, illegally and under the instruction of the respective Minister, who rushed to Police Station, who might have been supposed to be instructed by Shri Jyoti Basu) on the (alleged) ground of sickness. (Why he was not transferred to Hospital, if he was really ill) and the GDs of the case were destroyed under the Order of DC, S. D. dated 11.09.2002. Since the further investigation of the case was taken up by ARC, D.D., Kolkata, we cannot provide copy of the documents related to case…  

 

From the aforesaid information this is amply clear that aforesaid case never investigated in fair and free manner due to black money powers of Shri Kedarnath Fatehpuria and his close nexus with powerful politicians of the State.          

 

Time and time again, I have always referred that Railway should know that what is the demarcation of it’s own properties. In the matter of the aforesaid encroachments of the Railway Land by Land Mafia Sanjay Kumar Jhunjhunwala, even after preparation of the Survey Map by Eastern Railways under direction of the Central Information Commission, find out about 4,841 Square Feet land still under illegal encroachment and used in construction of two multistoried buildings. Therefore, this is evident form the fact that, even from my claims to the Railways, under which Railway Land under encroachment is much more, but even forgetting my claim, now Railway itself admitting through aforesaid Survey Map that Railway Land about 4,841 Square Feet is still under illegal encroachment and used in construction of two buildings. Therefore, the fact that aforesaid (illegal) agreement was executed beyond any doubts and ambiguity by the Railway just to protect the aforesaid encroached Railway Land by misappropriating in favour of Land Mafia upon which buildings were constructed much earlier then the date of execution of the said agreement.

 

Therefore, what is the reason that Railway instead of taking appropriate actions against Public Servants from the Eastern Railway, whose are responsible and were party under connivance to execute the said agreement for misappropriation of the Railway Property under gratification? And further more that what is the reason for not taking appropriate action to get vacated the aforesaid encroached Railway Land from the inhabitants of the aforesaid Railway land? But, most surprisingly Eastern Railway and its Sealdah Division still engaged to find out the illegal ways to protect aforesaid Public Servants and the aforesaid illegal agreement, which ultimately benefited to aforesaid land Mafia. While Eastern Railway through its Sealdah Division approached to Land Department of Government of West Bengal, to get certify the aforesaid Survey Map prepared by the Eastern Railway though its own sources. Finally, State Government refused to do so. This was appears from the Information received from the Eastern Railway, under the RTI Act, containing the correspondence between the State Government and Railway.
